On Wednesday, November 17, 2021, Senator Mike Braun (R-IN) and Congressman Fred Keller (R-PA-12) introduced companion bills, S.J.Res.29 and H.J.Res.65, a joint resolution utilizing the Congressional Review Act to nullify the Occupational Safety and Health Administration’s (OSHA’s) COVID-19 Vaccination and Testing Emergency Temporary Standard (ETS). The Congressional Review Act can be used by Congress to overturn certain federal agency regulations and actions through a joint resolution of disapproval. If a CRA joint resolution of disapproval is approved by both houses of Congress and signed by the president, or if Congress successfully overrides a presidential veto, the rule at issue is invalidated. This move to overturn President Biden’s vaccine or test mandate for private employers is guaranteed a vote on the floor, which is tentatively scheduled for some time in early December.
